回到咸陽後，胡亥繼位，趙高任郎中令，李斯依舊做丞相，李斯發覺趙高陰謀後，就上書告發趙高。秦二世胡亥不僅偏袒趙高，並且將李斯治罪，最後將李斯腰斬於咸陽。趙高升任丞相，由於他可以出入宮禁，於是，子嬰便假託生病，不理朝政。趁此機會韓談刺死趙高，並誅滅趙高三族，在咸陽城內示眾。
胡亥登基之後，開始了屠殺，秦始皇子女被杀尽。公元前210年，趙高李斯勾結，矯詔以始皇身份賜死扶蘇，扶蘇遂自盡。公元前207年，胡亥被趙高的心腹閻樂逼迫自殺於望夷宮，時年二十四歲。秦王子嬰元年（前207年）十月，劉邦率大軍攻破武關，此時，群臣百官也都背叛秦朝而投降劉邦。子嬰眼看大勢已去，親自到劉邦軍前投降。子嬰投降後，樊噲提議殺死子嬰，但劉邦沒有同意。項羽率領大軍進入咸陽後，立刻殺死子嬰，縱火焚燒秦宮室.
